Although Silas Massey had a will, one son-in-law took it & gave it to another son-in-law who destroyed it so estate was settled as if intestate. It was reported to the Mountain Creek Baptist Church that the son-in-law, Wm S. Shaw, had destroyed or unlawfully retained the will of Silas Massey. In Feb 1876 Shaw was excluded from the Church for the offense. The sons-in-law were upset that the will left land to his daughters in their names rather than their husbands. Also they thought the older children got more land. Most of the children were already living on land to be deeded to them by the will. The son-in-law who gave the will to the other was Sanford L Hall. Numerous lawsuits, petitions and depositions were gathered in this probate and totals several hundred pages. In spite of the protests of most of the heirs, Hall was named administrator by the Probate judge. In the end each heir had to pay for their land out of the estate settlement. This meant that some had to take out a mortgage to the probate court until settlement made. The women heirs had the mortgages in their names. The probate file is full of controversy and accusations.26,27 |
